I agree to the extent that you can also save games to external USB drives, so you could download them all and keep them for later. Not much different from buying physical copies and keeping them to rot away in some closet.
Yeah, it sucks that it's all tied to your console but honestly, if your DVD or BD were to get damaged, you wouldn't get a refund either, so who cares? Of course I'm still gonna buy physical exclusively (unless a game has been discounted to like 2 bucks). Plus by now it's easy to pirate so if you're really missing games, then just pirate them bro. Purchases on the Nintendo eShop should have been account-tied in the first place, not console-tied.
Nintendo used Gamespy for their Wii and DS servers and they never thought or cared about the possibility of it ever shutting down.
