From a pragmatic point of view it should be completely legal. If it weren't, it increases the probability of actual children being victimized.

No. Loli hentai with rape/harsh molesting should be illegal, and softcore porn or photos of child models should be legal. If we ban every sexualizing minors stuff, pedos wouldn't have any reason to consume loli hentai instead of hurtcore

Regarding all of this. I saw another thread which was a loli dump and someone made the argument that if loli is illegal than killing people in video games should be as well as both are ideally the same. Killing someone in a game isn’t the same as killing someone. Just like owning loli hentai or making it should not be considered as cp and should not be charged as owning child pornography cause no one was harmed in making the material.

Two basic reasons, both arguable depending on what studies/information you accept as credible:

1. Lolicon should be legal, because the characters shown aren't based directly on real people (in this case it would be underaged victims...and that's assuming you accept the label "lolicon" specifying an actually underaged girl, and not merely a girl of any age who looks underaged). Regardless, because there's no direct living victim being featured, it's neither rape, or creating profit off of the subject matter's direct suffering. The ONLY time Lolicon should be illegal is if the hentai in question was created off of a reference source that is actual child pornography, rape, etc. It would also need to be proven to be directly based off of it, and not made either coincidentally, or its vaguity is such that it happens to look the same. Since doing this in court is nearly IMPOSSIBLE without the offender admitting to it, it's pretty much a moot point.

2. Lolicon should be legal, because as something detailed in the above example, it falls under freedom of speech/expression (at least in the US it does). Is it weird, you bet ya. Does it say a lot about the person viewing/enjoying it? I'd argue it does, and I wouldn't want my child spending time with them, but regardless of all of this it's STILL freedom of speech and expression.

You can argue the logistics of "But it'll prevent actual pedophilia and make society better," despite an argument being made which suggests it actually decreases instances of pedophilia (since it gives the pervert a safe alternative outlet which creates no victims). This is similar to people who make the tired argument that videogame violence leads to real life violence (even though multiple studies show this isn't the case at all). Regardless, I wouldn't want to live in a world where peoples' "feelings" dictate legality. It sounds like living hell.

So that's my argument. Troll your bullshit one all you want, I don't care.

Laws don't care about ideals. Ideally, we should be better, but laws involving protecting freedom of speech (no matter how gross and perverted it is) should allow it since there's no victim.
