You're going to get slammed with "Subject to change without notice" clause on essentially every piece of media ever made, not to mention false advertising has to be deliberately and knowingly false with the intent to deceive. Any good judge, who has a vested interest in not wasting their own time, will advise you to reconsider your decision.

I refuse to play the game, but I can say earnestly you stand nowhere... probably. I don't know how legal discourse works in your country, but in mine false advertising as a civil charge is more about the claims of what a product can do and if it's intentionally made to defraud customers. For arts and media is different. If someone involved in the production of a movie says, "It's the greatest movie ever," you can't really take them to court because you can't prove fraud.

Making claims of quality are one thing, since quality cannot be objectively quantified. But making claims such as "It is very faithful to the original [work]" can be verified through inspection and contrasting, and if such claims are found to be baseless, then you have a case.

Was it misleading? Yes. A ton of it was misleading. But misleading isn't going to be determined to be false. There's a large window where companies can do shit like this and never risk being punished for it. Even if they do cross the line the legal hurdles to even attempt to get them to admit it are far more costly than people are willing to pursue all for the sake of getting back your $60.
As customers we don't have any fucking choice but to simply never pre-order games or buy them on day-one. It's a shitty reality but it's our reality.

You have to prove that person's interpretation of the matter and how much control over the entire project they had to have a case. After that, you must prove active fraudulence. It's not impossible, but it's highly unlikely. Both of our analogies are bad. Clearly, it's not statements of quality, not statements of genre... it's statements to "how close is this to the original?" I would be interested in seeing this pan out actually, but a good judge probably would allow this to spare a plaintiff.
