As to why they are doing it - there are some trademark related rules that if you don't protect your brand legally you lose some of your rights over it. Remaining silent is line giving a legal agreement to use your IP and if you wait too long it becomes permanent. I'm not a lawyer and didn't read all these rules, I'm just saying there's a good chance they are obligated to take legal actions if they don't want to lose the mario IP completely.
