Neither is morally justifiable, by any stretch of the imagination. BUT, a person not prone to evil acts is more likely to commit murder in that case. Rape, the way I see it, would be on the same level of deciding to take your revenge through torture, they're both acts which require continuous malice. Murder doesn't, really.
