Anyone who read the chapter as a whole knows this. James starts by introducing a situation where a rich and poor man walks into the congregation. The rich man is treated with respect and honor at the expense of the poor who is asked to sit down "under thy footstool".
Because of this, James states right after that the poor are those who are chosen by God showing the stark contrast between the possible actions of the audience and that of God. This also serves to stress that as Christians the audience should not do this and be impartial. Which is why verses 4-6 uses Leviticus 19:15 as a source or intertext. Both share the theme of judgement though in Leviticus 19:15, the point is one should not be partial in judgement which is what James audience had done based on the previous verses.
After this James says,
8If ye fulfil the royal law according to the scripture, Thou shalt love thy neighbour as thyself, ye do well:
9But if ye have respect to persons, ye commit sin, and are convinced of the law as transgressors.
10For whosoever shall keep the whole law, and yet offend in one point, he is guilty of all.
11For he that said, Do not commit adultery, said also, Do not kill. Now if thou commit no adultery, yet if thou kill, thou art become a transgressor of the law.
12So speak ye, and so do, as they that shall be judged by the law of liberty.
13For he shall have judgment without mercy, that hath shewed no mercy; and mercy rejoiceth against judgment
Here the royal Law James refers to is not the Mosaic Law as James first list out the love command which is similar to what Jesus gave in Matthew 22:34-40. Given the use of "royal" and "liberty" to refer to this law, it is not the ordinance of the Torah where one is expected to keep all of them but it is that of Christ which he lays out for believers to follow.

Failure to follow this law will make the lawbreakers convinced as transgressors. The word "convinced" or the Greek elencho often means "reprove" (a sinner; cf. Matt. 18:15) or "refute" (opponents; cf. Tit. 1:9). Sometimes it has the legal sense of "convict" (of wrongdoing; cf. also John 8:46; 16:8; 1 Cor. 14:24; Jude 15). Those believers who fail to abide by this law are "transgressors", which is the technical NT term for a person who directly disobeys a positive command (see also v. 11; Rom. 2:25, 27; Gal. 2:18; and note the use of the related term "transgression" in Rom. 2:23; 4:15; 5:14; Gal. 3:19; 1 Tim. 2:14; Heb. 2:2; 9:15).
This sort of harsh language wouldnt make sense if James is merely having "justification before men" in mind especially when eschatological final judgement is referred to in context of calling those who are partial in their treatment of people as transgressors convicted of wrongdoing and disobeys God. The eschatological judgement is clear in verses 12 and 13. Those who show no mercy, will receive judgement. This judgement is also not some temporal judgement but the final judgement where all are judged as this is most coherent with other NT verses on this and conditionals to obey such as 2 Corinthians 5:10, Matthew 25:31-46 and 1 John 3:24.
This is what sets the stage for the discussion of what real faith is. But Protniggers ignore context just so that he can justify projecting "muh justification before men" into the text.
With this in mind we proceed to James discussion of true faith. Firstly he asks,

PROTNIGGERS taking this dead faith as being able to save shows they dont know James 2 because when James poses this question, he is engaging in what is known as a diatribe where the answer will be "of course not!". He also introduces an interlocutor in this section.
As the rhetorical context(although it is so obvious without this) shows that James expects the answer to "Can a dead faith with no works save?" to be no, James 2 is not referring to justification merely before men as he is clear that the Baptist kind of faith cannot save. It is even considered the faith of demons.
So why did James then say he will show his faith by his works?
James' declaration is one made right after he illustrates a hypothetical or even possibly real situation where one of his audience seeing a brethren in need simply says "depart and go in peace". This doesnt help the poor brethren at all and by analogy, a faith with no works, is of no help at all. It is dead, like the brethren neglected.
James inserts a possible response from an interlocutor which says that "you have faith, I have works".
This verse could mean that James is citing someone who supports him or that it could be a way to identify two different positions and consider faith and works to be separated from each other in nature. The latter view flows well with James' later response which indicates faith is active in nature and expresses itself by action. This serve to contrast the illustration of neglect of feeding and caring for a poor brethren. This also serves to make the proceeding verses coherent as James compares "faith" which is not active as those of demons who believe and shudder and later provide OT examples of those justified by works before ending with a statement that faith without works is like a body with no soul. Dead. This makes Protniggers eisegesis a failure as James doesnt intend to say justified before men but is discussing an issue which is even salvific in nature>
