Feds for specifically and deliberately choosing to go in guns blazing in a large scale frontal raid to show the world who's boss. Feds for getting blown the fuck out by the Branch Davidians because the BDs were prepped and expecting this type of violence at some point from some actor, and instead of retreating and owning up to their outrageous decision and trying to negotiate, instead doubling down and creating a prolonged siege situation. philosophically speaking, as with most civil war conflicts (think=IRA conflict in Northern Ireland), there is a complex mix of both sides making major mistakes and leading to a cycle of violence.
Both sides could have acted better.
the ultimate question is, who started the fire in the compound? Because a tear gas attack even on women and children is probably not a war crime, but fire is. And mass suicide by fire is of course a horrible thing to do.

Gordon Kahl was a tax protestor and an early proponent of the sovereign citizen movement. He sent a letter to the IRS colorfully calling them illigitimate and telling them he would nolonger be paying taxes in any form and that he would like his social security cashed out as is. He would nolonger be doing any financial business with the federal govt. He was sent to jail for a time for this but he started to really draw fed attention when he started calling into radioshows talking about the federal reserve and the IRS and taxation schemes. The english commonlaw interpretations of ligitimacy of federal bodies really got the feds riled up and so some years later the US Marshalls would try to arrest him for parole violation. All reasonable interpretations point to the feds, as they are want to do, starting a firefight, but the Kahl family in the car they were traveling in before they hit the Marshall roadblock was armed as well so a shootout ensued. The result was several dead feds and the Kahls on the run. Shortly thereafter they would be confronted again, and once again superior firepower and tactics resulted in more dead feds. That's when the large scale manhunt began and things get murky. It's all in the linked video above. It's worth checking out, it's very surprising how few people are aware of Kahl even amongst people who are well versed in what happened at Ruby Ridge and Waco.
