Dick Pusey, who runs Switch Now Home Loans, is an avid social media user who frequently uploads videos of himself racing his Porsche 911.

His car, which was also filmed speeding down the same highway on March 21, also features prominently in his dozens of TripAdvisor reviews of anything from pubs to the Melbourne Airport Skybus.

Pusey previously made contact with police and was urged to turn himself in. He is currently assisting the Homicide Squad with the investigation.

Mohinder Singh Bajwa, the driver of the truck - who had a 'medical episode' - remains under police guard in hospital.

Three male officers - including one in his first week in the job - and a female senior constable who were standing in the emergency lane on the side of the freeway were killed when the out-of-control truck veered into the group.

The federal courts job is to interpret the constitution.

The states can cede any powers by consent to the Federal government though - that's why all the Family Law stuff is federal, not just births and marriages like the constitution guarantees.

Either way that doesn't matter - it's the state governments that are enforcing lockdowns right now anyway. The state governments have the power to legislate literally anything as long as it doesn't abrogate a Constitutional right or guarantee, and the Constitution says nothing about a right not to be forced to stay at home, or a right to operate a business

It's probably unconstitutional but the High Court would tell you to fuck off if you tried to bring it because it has full discretion over which cases it wants to hear and which ones it doesn't. Even if it heard the case it would probably say it was fine because of the pandemic because the constitution is actually kind of murky on freedom of movement.

The High Court has been playing with this trick in recent decades where it basically says 'the Constitution gives you a right to X but it can be overridden if there is a good reason for it'. It's something the German constitutional court does which we have started to semi-import.
