It's all about the concept of "viability", the ability for the fetus to survive on its own outside of the uterus. That's what the entire ruling of Roe v. Wade was based on and "viability" was set at about 28 weeks.

So there you go. Also, there is no guarantee that thing would have been born anyway, could have been still-born or a miscarriage could have occurred, this whole "taking of potential life" line doesn't hold up when we get into the weeds of it.
