10 is a policy decision. Limiting it to groups of 2 would be better, but marginally. They are striking a compromise to still allow some things to take place while still significantly limiting the spread.

Your first point is wrong. Leftists will challenge Jacobson's applicability to abortion. Your second point is correct. The way some governments are going about it (citing people in their cars) would in no way pass strict scrutiny. On the other hand, no judge want to be "that guy" responsible for causing hundreds or thousands of deaths within a few months because he cockblocked the government efforts to slow/stop the spread.

It's not about losing their job (they won't). It's about their conscience, being horribly BTFO in appeal, and even risk from the family of those killed by COVID-19. You can't attack China. You can't rationally attack a Chink. But you would be able to, with some rationality, attack a judge that might be blamed by the media for causing tens of thousands of deaths. Judges cause people to die all the time but usually over the course of decades, not months.
