he's not technically a saint. one can be beatified without being a saint. some locals regard him as a saint, a lot of cases like this gather a "cult"-like following. but he's not a saint, no. the fact that the painter called him "st. simon" in the work's title pretty much ensures the Catholic church won't get to say anything based about it, because he's not a saint (at least, not within an official capacity)

whether or not he should be is up for debate. I believe that if someone dies before what the church deems "the age of reason" aka they aren't mature enough to understand good/evil, then they can't technically become a saint, but I may be wrong

It is a work of art, it is beautiful, puts folklore and religion back to the core of artistic production and conveys a specific message -- plus, the fact it got censored conveys another message, a clear one.
