Don't quote me and I'm not a lawyer, but I think the basis for HOA's power is contractual. If you agree to a HOA's contract, then that's as valid as any other contract. The shit of it is, many of these agreements pass on to a new owner of the house and this is a term of that original agreement. That said, if you own the house and a HOA is created for that community and you're asked to join, you can tell them to fuck right on off and you are under no legal obligation to contract with them regarding property that you already own.

HOAs became popular in the 60's and 70's in the US, mostly due to rising crime. Whites had been purged from many cities during the 1960's by riots and violence, and were ready to embrace these kinds of organizations in order to feel safe.

Contracts that break the law are never legal. If I sell a car that I don't own, that contract is illegal from the beginning and not enforceable. I know someone who bought a car that turned out to be stolen, he had to give it back to the rightful owner.
