He probably wasn't even drinking that much, but refused the breathalyzer. In Texas if you refuse the breathalyzer, the officer can give a field sobriety test, and if you fail, you get booked on DWI. Totally officers discretion, but not having the breathalyzer data available makes it much easier for your attorney to beat it in court. NEVER EVER EVER CONSENT TO A BREATHALYZER TEST

I actually don't know the size of the fine here other than it's quite a bit. Verdict is a couple months. You can't drive for two years after.. .not that you actually need do actually do something for them to take your license here...

If you refuse a breathalyzer they draw your blood, and the blood test is basically irrefutable. They can tell how much you drank, and how long ago you were drinking.
Theres no beating it. Breathalyzers are scary accurate on their own regardless. The advice is to never drink and drive, not be a retard and think you can skirt a charge by refusing and getting locked up like a nigger.
