I see it kind of like Jojo where the protagonist would have to get around the enemy's abilities and play style in order to defeat them, you can easily have a battle last a full episode or two if you're creative

二次創作 != doujin. It literally can't be doujin if it's produced as a commercial product by a major studio. The distinction between doujin, commercial and derivative products is one of the key points his changes actively addressed.

Also, it's inferred. ZUN had made it well-known that he was staunchly against a commercial anime product for Touhou because he was worried it would draw attention away from the source material. It's easy enough to deduce from the fact that it was a commercial derivative product that he knew nothing about and the fact that a) it became highly regulated and never got an official release and b) ZUN drafted an extensive detail on what is and isn't allowed for commercial derivative products (which, I'd like to point out, included animation projects, outlined on the blog page) which would include the collab anime. Note in the details it doesn't say "ask for permission to make it", it straight up says don't do it, end of story.

I don't think there were any, just ZUN's personal stance on commercial anime. ZUN has been fucked about a lot on the legal front, IIRC the very next year some cheeky cunt made a bid for the Touhou Project trademark and actually succeeded and ZUN has been trying to get it back ever since. Needless to say he didn't have much in place because he probably didn't think he needed it.
