Because Batman is just as insane as the villains he puts away, he just has an aversion to killing rather than a compulsion to kill.
Plenty of Batman comics and other characters have pointed out that Batman's steadfast line against killing does way more harm than good.

There was some horrible human characters in there, and redeemed Parasytes, but the Parasytes were always the bad guys.

I like when they spare the villain to face justice. There's nothing wrong with letting the guillotine take them after a very public court hearing recounts their crimes for all the victims to get their satisfaction. It also works for the majority of MCs that are more or less moralfags, and might even be more satisfying to the viewer.
The only problem is when the protagonists display zero foresight and allow "justice" to take the villain only to let them escape, fail to punish them, or straight up just exile them with a slap on the wrist and they come back and fuck way more shit up. That is fucking infuriating.

Lupin is fucking great and the anime is based entirely around this premise.

It also just kind of negates the entire point of having a serialized shared universe. Which is why we have continuity reboots every ten years.
