How did he flunk out with a quirk that good? It takes proper planning and set up to be effective but it's better than a having a tail.

He's not even really a villain even if he wants to be one. Society took a shit on both him and La Brava and they weren't strong or lucky enough to pick themselves back up except in defiance of it.
That's what bugged me about this arc, Deku was never a hardcore lawfag, he always fought for the greater good which got him in trouble multiple times. Now here he is holding a defeated man in the dirt while a girl cries and intends to ruin both their possible futures for very minor crimes. Literally all he had to do was make Gentle promise to leave UA after he was beaten and broken.

Hori is not a very consistent writer, you should know that by now.

I don't think using his quirk on Deku's gloves would be enough, honestly the best outcome Gentle could have gotten in that fight is an escape, and he'd probably have to make all of Deku's clothes, the ground, the surrounding trees and air elastic to make pursuit next to impossible because the autistic hard-on Deku had for making Eri smile would have pushed him to pursue Gentle
seriously he was as aggressive with Gentle as he was with Muscular all because of a festival that, in universe, should have been considered a big waste of time

I don't think Deku even really cared about the legal reprecussions to the school that Gentle's infiltration of UA would have caused
he only cared about Eri, literally if Gentle had done it the next day, Deku would just be slightly bummed out
