If they had asked “did Bob rape Emily,” or if they’d said “the reason this counts as rape is because Emily could not consent” I would agree there was a double standard there. But if they only ask “is this rape?” and don’t specify which party is the rapist or victim, then I can only assume this is a case by case basis, and there are situations in which Emily could have been raping Bob while they were both drunk just as easily as Bob could have been raping Emily. The question doesn’t give me enough data to conclude what happened.
