part of copyright law is that the holder has to openly demonstrate that they're actively protecting their copyright
if they let all these people run around and do whatever they wanted and Nintendo had zero history of ever doing anything about it, then an ACTUAL game dev studio could make a literal Zelda or Mario game, and when Nintendo takes them to court, Nintendo having no history of protecting their own copyright sets a very strong precedent, and it could get thrown out of court, this has happened in the past with multiple high profile cases in other mediums
Nintendo has to show that they're protecting their copyright in every instance, they can't be selective
